Gift Aid - transitional relief

In the Budget on 12 March 2008, the Government announced proposals to support Gift Aid and its benefit to charities and Community Amateur Sports Clubs (CASCs).

The basic rate of income tax falls from 22% to 20% from 6 April 2008. This means that, whereas a donor would be able to increase his donation from, say, £78 to £80 without loss of disposable income, in practice many donors would omit to do this, resulting in a loss of income for the charity.

Companies Act 2006 - where are we now?

It was as far back as November 2006 when the new Companies Act 2006 (the Act) received Royal Assent. Early in 2007 the government outlined a timetable for the Act´s implementation and at that time three key dates were announced:

  • 1 October 2007
  • 6 April 2008
  • 1 October 2008
In November 2007 the government made a further announcement that the final implementation date would be delayed until October 2009 and a final timetable has since been published.

Charities Act 2006

The third order commencing provisions of the Charities Act 2006 has been made, bringing a number of provisions into force on 18 March 2008. The provisions commenced by this order are:

  • The Charity Tribunal
  • A new power enabling the remuneration of trustees for providing (non-trustee) services to their charity
  • Several updated powers for charities
  • Three new powers for the Charity Commission
  • Changes to the law of cy pres

A fuller explanation of the provisions brought into force by this commencement order is available on the Office of the Third Sector website.
