Post Election Budget June 2010
The press headlines have mainly been in relation to the measures to reduce public spending, changes to allowances and the tax rate changes, particularly the VAT increase to 20% from 4 January 2011 and CGT to 28% for higher rate tax payers. Further details are given in the summary document however without wishing to give a distorted view of the changes some of the positive changes for taxpayers are noted below:
- Entrepreneurs Relief being retained and the lifetime limit increased so that qualifying gains of up to £5 million will only suffer tax at 10%.
- The main rate of corporation tax is to be reduced from 28% to 27% and then by 1% per year until it is 24%.
- The small companies rate of corporation tax is to be reduced from 21% to 20% instead of increasing to 22% as previously planned.
- The new rules which were due to take effect from 6 April 2011 to restrict higher rate income tax relief for pensions contributions of those with high incomes are being repealed and will be replaced by other rules possibly with an annual allowance of £30,000 to £45,000.
- The requirement for a pension scheme member to buy an annuity from the age of 75 is to end and whilst the new rules are being considered there is an immediate increase from 75 to 77 in the age at which an annuity must be purchased so no one falls into the current rules in the meantime. Furthermore, the press release announcing this immediate change also gives a hint at another possible change; it states that the specific IHT death charges on pension scheme members who are in drawdown and are aged 75 or over when they die will not apply in the interim period before 6 April 2011 (those IHT charges together with other 35% tax charges on lump sum death benefits gave potential composite tax rates of 82%). Whilst it is only the interim period to 6 April 2011 which is mentioned in the press release, when the new rules are decided hopefully the 82% charge will no longer be a risk.
- A new employers’ national insurance exemption for start up companies outside London and the South East for up to 10 employees.
